The decision gives weight to evidence from licensing, residents and nuisance proceedings on noise, health and highway safety, while also showing the importance of precise enforcement notice requirements. (3346972)

Staffordshire Moorlands: Enforcement notice quashed over the alleged breach
An enforcement notice alleging the material change of agricultural land to residential domestic garden was quashed on ground (b). The Inspector found that the land had changed in character, but that describing it as a residential domestic garden was not accurate on the facts, and that varying the notice to a different formulation such as domestic outdoor space would cause injustice. (3377456)

Hammersmith and Fulham: Class MA appeals fail on late evidence and technical gaps
Prior approval appeals for three flats were dismissed. The Inspector declined to accept amended layouts and updated technical reports at appeal stage, applying the principle that the appeal process should not be used to evolve a scheme. The dismissals turned on insufficient original information on refuse arrangements, contamination, flood risk in Flood Zone 3, noise and natural light. (6010163, 6010167)

Horsham: Class Q conversion rejected as effectively starting afresh
A prior approval appeal for conversion of an agricultural barn to a dwelling was dismissed because the proposed works did not fall within Class Q. Although the retained steel frame was accepted as structurally sound, the Inspector found that replacing the roof covering and adding new external walls on all sides of the proposed dwelling went beyond conversion and was tantamount to starting afresh. (6007717)

Tameside: Modest infill dwelling allowed on a corner garden plot
Outline permission was granted for a two-bedroom dwelling, with access, layout and scale approved and appearance and landscaping reserved. The Inspector found that the site sat within a mixed pattern of terraces, semis and detached houses, and that the proposal would read as a logical continuation of the existing terrace without harmful loss of openness. The decision is notable for recording the new small site Biodiversity Net Gain exemption applying to a 0.032 hectare site. (6009460)

Tendring: Replacement workshop refused after updated flood mapping
A proposal to replace an existing marina workshop was dismissed because no site specific flood risk assessment had been provided for a site now shown in Flood Zone 3. The Inspector gave no determinative weight to an earlier permission for a nearby building granted before the mapping change, and held that replacement development still needed current evidence on flood risk, mitigation and climate change. (6006959)

Barnet: Commercial plant refused on listed parade
Planning permission and listed building consent were refused for kitchen extract, condensers and associated plant at part of a Grade II listed parade within the Golders Green Conservation Area. The Inspector accepted that the café use delivered social and economic benefits, but found that the scale and prominence of the plant on the rear service elevation caused modest harm to designated heritage assets which was not outweighed. (6004392)

Dudley: One child care home allowed with a tight use condition
Permission was granted for the change of a dwelling to a Class C2 children’s care home for one child. The Inspector found that the fencing, parking and retained garden space were acceptable in the estate context, and attached a condition restricting the use to a children’s care home for one child and no other Class C2 use. The Inspector removed a £25,000 cycle route contribution and a £24,500 bus stop contribution where they no longer served a useful purpose, but retained the £63,800 Primary Public Transport Corridor contribution because the mitigation had already been delivered and the Council was entitled to recover committed expenditure. (3376196)

Gravesham: Trench works lawfully implemented two dwelling barn conversion
A lawful development certificate was granted confirming that a barn conversion permission for two dwellings had been implemented by digging a trench for foundations. The Inspector found that a non material amendment had expressly allowed those limited engineering works before discharge of the surface water condition, meaning the permission had been lawfully commenced. A full costs award was made against the Council for unreasonably refusing and defending the LDC appeal. (3361359)

Brent: Enforcement notice quashed for ambiguity and four year immunity
Two linked enforcement appeals produced important enforcement findings. One notice was treated as a nullity because its requirements and plans were ambiguous, leaving the appellant unable to know with reasonable certainty what compliance required. A second notice alleging conversion to two flats was quashed because the appellant’s evidence showed the use had begun before the relevant four year date. (3345487)

Torridge: Agricultural only condition prevented Class Q conversion
A Class Q appeal for one dwelling was dismissed after the Inspector raised the effect of a condition on the original barn permission requiring use for agricultural purposes only and for no other purpose. The Inspector found that Article 3(4) of the GPDO prevented permitted development rights being exercised contrary to that condition, so the proposal could not proceed under Class Q. (6010409)

Maidstone: Gypsy pitch refused despite unmet need and personal circumstances
A retrospective proposal for a one plot residential Gypsy site was dismissed because the access onto the A274 had poor visibility and created an unacceptable highway safety risk. The Inspector gave considerable weight to the best interests of the children, the lack of a five year supply of Gypsy and Traveller sites, protected characteristics and personal circumstances, but found that highway safety and risk to life were overriding. (6003947)

Mole Valley: Temporary rural workers dwelling failed essential need test
A temporary static caravan for an equestrian worker was dismissed. The Inspector found insufficient evidence that a continuous on-site presence was essential rather than convenient, noting limited evidence on the frequency of emergencies, breeding needs, security alternatives and the business case. The appeal also failed on accessibility and landscape grounds within the countryside and Area of Great Landscape Value. (6007601)

Birmingham: HMO lawful use certificate refused for insufficient Article 4 evidence
An appeal seeking a certificate for existing C4 HMO use was dismissed. The appellant argued the use began before Birmingham’s city wide Article 4 Direction came into force, but the Inspector found the evidence insufficiently precise, unambiguous and comprehensive to prove the use on the balance of probabilities. (3374627)

Hammersmith and Fulham: Digital street hub refused on conservation area harm
A multifunctional street hub with an integrated digital display, defibrillator and public communications functions was refused on non-determination appeal. The Inspector found no highway safety harm, but concluded that the structure would be an incongruous and prominent addition within the Shepherd’s Bush Conservation Area and would harm the setting of Granville Mansions as a non-designated heritage asset. Landscape and minor designated heritage harm were given significant weight, but were outweighed by renewable energy generation, energy security and biodiversity benefits, including a reported 54.33% habitat net gain. (6005916)

Cheshire East: Listed coach house conversion dismissed after hearing
Following a hearing, proposals to convert a curtilage listed coach house at Grove House and connect it to the main listed dwelling by a glazed link were dismissed. The Inspector accepted that a revised link could be neutral, but found that internal alterations, loss of historic fabric and large arched openings would erode the former coach house’s legibility and harm the listed building. (6006023, 6006027)

Barnet: Brownfield fallback supports nine unit housing scheme
Permission was granted for redevelopment of the former Glebe Motors site to provide nine self contained residential units. Although a seven-unit scheme was an extant fallback, the Inspector treated the appeal as a fresh assessment and found that lower ground floor living spaces, outlook, privacy and outdoor amenity would provide an acceptable standard of accommodation. (6010903)

Dorset: Class Q succeeds where repair works did not materially alter the building
Prior approval was granted for conversion of an agricultural building to two dwellings under Class Q. The Council argued that recent works prevented reliance on Class Q, but the Inspector found that replacement roof sheeting, timber cladding and internal timbers did not materially affect the external appearance and therefore did not amount to development for the relevant limitation. (6009129)

Barnet: Short term let unit assessed on its C1 merits
A roof extension and conversion to one Class C1 short term let unit was allowed. The Inspector found no policy basis for protecting vacant loft space as latent future C3 housing and assessed the proposal as C1 accommodation, noting that London Plan C3 space standards were relevant guidance but not directly applicable. (6008189)

City of York: Digital advertising turns on site specific public safety evidence
A single decision covered 12 digital bus shelter advertisement appeals. Eleven were allowed and one was dismissed because the display would be visible in a complex highway environment with petrol station movements, junctions, a bus gate, cycle lanes and pedestrian facilities. (6009003, 6009023)

East Lindsey: Enforcement notice quashed where the alleged change had not occurred
An enforcement notice alleging a change from agriculture to a private residential caravan site was quashed on ground (b). The Inspector found the land was a single residential planning unit, that two occupied static caravans were incidental to the dwellinghouse use, and that the storage use found on the evidence was fundamentally different from the allegation. (3378456)

West Oxfordshire: Agricultural occupancy condition remained in force
An LDC appeal seeking to retain an open market dwelling as built was dismissed. The appellant argued that the barn conversion differed so materially from the 1989 permission that the agricultural occupancy condition did not apply, but the Inspector found the differences were not material when assessed against the approved scheme as a whole. (3355154)

Cotswold: Self build replacement dwelling fails on non designated heritage asset loss
A self build replacement dwelling in Rodmarton was dismissed because demolition would result in total loss of a non designated heritage asset associated with the Arts and Crafts movement. The Inspector found no harm to the setting of nearby Grade II listed cottages, the conservation area or the Cotswolds National Landscape, but the limited benefits of self build, sustainability, landscaping and biodiversity did not outweigh the heritage harm. (6007188)

Shropshire: Temporary agricultural worker mobile home allowed for poultry unit
A three year permission was granted for an agricultural worker mobile home at a 32,000 bird free range egg unit. The Inspector accepted that automated systems, bird welfare, security and short response times established an essential and functional need for a 24 hour on site presence, and found that off site accommodation would not meet that need. The Inspector found moderate to minor landscape and visual effects, lowermost less than substantial heritage harm to a listed farmhouse, and no unacceptable noise impact subject to a detailed acoustic condition. With Maldon unable to demonstrate a five year housing land supply, the scheme was found to comply with new NPPF Policy S5 for development outside settlements, while limited weight was given to out of date settlement boundary policies. (6005664)

Warwick: Safeguarded land appeal allowed with partial costs award
Outline permission was granted for up to 140 homes on safeguarded land south of Westwood Heath Road. The Inspector found no prejudice to comprehensive future development of the wider safeguarded area, noted the Council’s housing land supply shortfall, and gave substantial weight to housing delivery. A partial costs award was also made against the Council because its refusal reason was not suitably justified and was not defended at appeal. (6002759)

Bradford: Inquiry enforcement notice upheld after limited immunity findings
An enforcement inquiry concerning concrete pads, buildings, septic tanks, stockpiling and access tracks at Jacobs Wood Farm was dismissed overall, with the notice corrected and varied. The Inspector accepted immunity only for the siting of buildings and concrete pads in two areas, reduced the replacement tree requirement from 300 to 100 trees, and extended compliance periods. A partial costs award was made against the appellant for the late withdrawal of the ground (a) appeal. (3378147)

Slough: Lawful development certificate granted for hardstanding
A hearing succeeded for a certificate confirming the lawfulness of hardstanding ancillary to transport maintenance and office use. The Inspector gave significant weight to statutory declarations and photographic evidence showing substantial completion more than four years before the LDC application. Resurfacing works in 2022 did not amount, as a matter of fact and degree, to a new operational development. (3378510)

Gravesham: Mixed use enforcement upheld at former Norbond site
The Inspector upheld an enforcement notice against a mixed use comprising self-storage, scaffolding storage and distribution, and a builders yard. The decision is notable for its treatment of the whole site as a single mixed use planning unit, its correction of use class wording, and its conclusion that containers and associated equipment could be required to be removed as ancillary works to remedy the breach. A 10 year immunity period applied to the mixed use, and the appeal failed. (3352876)

Staffordshire Moorlands: Grey belt finding did not outweigh conservation harm
An outline appeal for a single bungalow at Bagnall was dismissed. Although the site was treated as grey belt and not inappropriate development in the Green Belt, the Inspector found unacceptable harm to the character and appearance of the area and to the setting and significance of Bagnall Conservation Area. The limited benefits of one dwelling did not outweigh the heritage harm. (6008539)

Cherwell: Ground (g) enforcement appeal rejected for scaffolding yard
An enforcement notice against a sui generis scaffolding yard on agricultural land was upheld, with corrections to the wording of the allegation and requirements. The Inspector found that the appeal was effectively seeking more time after ground (a) was barred by section 174(2A), and that the appellant had not justified longer compliance periods for ceasing the use, removing structures and restoring the land. The decision applied paragraph 155 of the Framework, finding the two limited areas to be grey belt land, noting an agreed lack of five year supply of traveller sites and a sustainable village edge location. The notice was upheld for the wider land outside the approved areas. (3378286)

Cheshire East: Concrete batch plant dismissed on residential noise evidence
A hearing appeal for a partly retrospective concrete batch plant and B2 use at Wrenbury was dismissed. The Inspector found the submitted noise assessment insufficient, particularly on baseline conditions, receptor selection, modelling assumptions, tonal and impulsive characteristics and cumulative activity across the wider site. (3377066)

Kensington and Chelsea: Brownfield mixed use redevelopment allowed
Permission was granted for demolition of an industrial unit and redevelopment with flexible Class E floorspace and 7 residential units on Latimer Road. The Inspector gave weight to the site allocation, neighbourhood plan design guidance, the completed unilateral undertaking and the Framework support for brownfield land, finding no unacceptable effect on conservation area setting or neighbouring living conditions. (6005682)

Havering: Ten bedroom HMO allowed after amended parking layout
A ten person sui generis HMO in Romford was allowed despite some conflict with amenity policy. The Inspector treated the lawful 6 person HMO fallback and formalised five space parking layout as important considerations, and concluded the harm would not significantly and demonstrably outweigh the benefits of lower cost housing in an accessible location where housing land supply was not demonstrated. (6009771)

Bournemouth Christchurch and Poole: Nine flat outline scheme dismissed despite housing shortfall
An outline appeal for 9 flats at Denmark Road, Poole was dismissed. Although the site was in a sustainable location and the Council had a serious housing land supply deficit, the Inspector found a cramped form of overdevelopment, less than substantial harm to the Heckford Park Conservation Area setting, unacceptable living conditions, overlooking and no legally effective habitats mitigation. (6005194)

Islington: Loss of seven flats to one dwelling dismissed
The Inspector dismissed a proposal to convert 7 self contained flats into a single five bedroom dwelling. Even though several studios were below national space standards, the decision applied local policies requiring efficient use of land and optimisation of housing delivery, finding that the net loss of housing stock and lack of higher priority smaller units had not been justified. (6007475)

Hertsmere: Green Belt bungalow allowed on previously developed stable site
Permission was granted for a bungalow replacing stables west of Green Street, Shenley. The Inspector found the proposal fell within the previously developed land exception and would not cause substantial harm to Green Belt openness. Limited landscape harm was outweighed by housing supply considerations, with paragraph 11(d) engaged due to the Council’s housing land supply position. (6008668)

Colchester: Self build dwelling allowed outside settlement boundary
A custom and self build dwelling at Tiptree was allowed after the Inspector found the revised single dwelling scheme overcame earlier concerns about a two dwelling proposal. The decision accepted that Bull Lane’s condition and proximity to services made walking and cycling realistic, rejected unsupported infrastructure contributions under the CIL tests, and accepted RAMS and self build obligations. (6003588)

Hackney: Vacant youth club floorspace allowed to change use
The Inspector allowed the change of a vacant basement youth club use to a drinking establishment with expanded food provision. Although the lawful use remained social infrastructure, the replacement youth club had never operated and there was no persuasive evidence of likely community occupation. The policy conflict was therefore given reduced weight against the benefit of bringing long vacant floorspace into active use.
